Terms of use

These terms are between IT ART Inc., an Ontario corporation ("we", "us"), and the person or company that downloads, installs, or runs AxialDB ("you").

License

We grant you a free, non-exclusive, non-transferable license to install and run this download on your own systems, within the published caps: 5 views, of which 2 may be live. The caps do not expire.

A paid license file can raise the caps on this same download. It does not change these terms, and it does not add a warranty or a support obligation, unless a separate written agreement says so.

What you may not do

• Give copies of the binaries to anyone else, or host them for a third party.
• Bypass the view caps or any other technical limit.
• Reverse engineer the binaries, except where the law does not allow this restriction.
• Remove copyright or license notices.

Components from other projects remain under their own licenses. Those licenses are in THIRD-PARTY-NOTICES.md in the download.

Do not use AxialDB where a failure could cause death or serious injury, including medical devices, aviation, and nuclear facilities.

No warranty

AxialDB is provided as-is, without warranty of any kind, including merchantability, fitness for a particular purpose, or uninterrupted operation.

You choose where to install it and how far to rely on it. You are responsible for evaluating it on your systems, for backups, and for the reports you build.

The free download includes no support and no SLA. What the product does, and the CDC create subset, is described in the download (README.md, cdc-limitations.md).

Liability

To the fullest extent permitted by law, IT ART Inc. and its directors, officers, employees, and contractors are not liable for damages arising from the software, including lost data, downtime, or lost profits. They are not personally liable for those claims.

Where a limit is allowed, our total liability for all claims arising from the software is the amount you paid IT ART Inc. for it. The free download is not paid for, so that limit is zero Canadian dollars.

This section does not apply to liability that the law does not allow us to limit or exclude.

Your responsibility for claims

If a claim is made against IT ART Inc. because of how you use the software, the data you put in it, or the reports you publish from it, you will cover the resulting losses and reasonable legal costs, to the extent the law allows.

When the license ends

If you break these terms, the license ends. Stop using AxialDB and delete your copies. We may also stop offering the free download. Ending the license does not delete data you already stored, but you no longer have a license to run the software.

Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction, except where a mandatory law in your country says otherwise.

Acceptance

Downloading, installing, or running AxialDB means you accept these terms.
